This prisoner appeals in error from a judgment of' the Criminal Court at Columbia upon a conviction of of the crime of manslaughter. The indictment charges him with the offense of murder in the second degree upon the body of William C. Rummage. He was-first tried and convicted of murder in the second degree, and adjudged to suffer confinement for tbe period of ten. years.
