This case upon its facts corresponds exactly with that of the Borough of Bellevue, et al., v. The Manufacturers’ Light & Heat Company, No. 32, October Term, 1912, 238 Pa. 388" court="Pa." date_filed="1913-01-06" href="https://app.midpage.ai/document/bellevue-borough-v-manufacturers-light--heat-co-6251456?utm_source=webapp" opinion_id="6251456">238 Pa. 388, in which the opinion has just been handed down. The same considerations govern here as there. The appeal is dismissed and the decree is affirmed.
