Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the defendants’ motion which was for summary judgment dismissing the complaint insofar as asserted against the defendant Thomas J. Petrone, and substituting therefor a provision granting that branch of the motion; as modified, the order is affirmed insofar as appealed from, without costs or disbursements.
The plaintiff allegedly was injured when she tripped and fell on a raised platform at premises owned by the defendants Thomas J. Petrone (hereinafter Petrone) and Maria Petrone. At the time, the plaintiff was an employee of Comforce Staffing Services (hereinafter Comforce), a temporary employment agency, and was working at the premises as a temporary administrative assistant for nonparty Petrone & Associates, LLC (hereinafter P & A). However, the defendants failed to proffer competent evidence in admissible form that the defendant Maria Petrone was a co-employee of the plaintiff.
