The first and fourth assignments of error are well taken.

We would not reverse for the first, but the second error (fourth assignment) ‍‌‌‌‌​​‌‌‌‌​​‌​​‌​‌​‌‌​​​‌‌‌‌‌​‌‌​‌​‌‌​​​​​‌​‌‌‌‌‍is fatal. See authorities cited in brief of appellant’s counsel.

Reversed and remanded.
