Cоunt XI fаils to аllеge the basic elements necessary for a constructive trust: specific ‍‌​‌​‌‌‌‌‌​​‌‌​​​​​​​​‌​‌‌‌​‌‌‌‌‌​‌‌​‌‌​​‌​‌‌​‌‌​‍property as the res, and fraud by the defendant in obtaining plaintiffs property.

In all other respects the Petition for Rehearing is denied.
