This was a citation for the settlement of executors’ accounts before the ordinary, which was taken by appeal to the superior court, where an auditor was appointed, to whose report the executors filed certain exceptions of fact. Subsequently one of the executors died, and his administrator was made a party in his stead. When the case came on for trial upon the exceptions to the auditor’s report, all the exceptions were stricken by the court for insufficiency of form, to which ruling the defendants excepted and brought the case here for review.
Judgment reversed.
