It appears from the record in this case that Fleming was tried and convicted before the mayor’s court of the city of Bainbridge for the violation of an ordinance of that city. He sued out a writ of certiorari from the judgment of the mayor, which he presented to the judge of the superior court. Upon consideration of the certiorari, it appears that the judge refused to sanction the writ, whereupon Fleming filed his bill of exceptions and alleged as error the refusal of the judge to sanction said writ.
