This is a bill of exceptions taken in the course of a trial of issues of fact by a jury in a suit in equity in the Superior Court. Although considerably more than a year has elapsed since the exceptions were taken, the record before us does not show that there have been any other proceedings in the case since the jury returned their verdict. The first question to be considered is whether the exceptions should be heard in this court before a final hearing on the merits, both upon the law and the facts.
