An action was brought by Rogers against the Firemans Fund Insurance Company of San Francisco, the •object of which was, (1) to compel the defendant to specifically perform an alleged contract to execute and deliver to him a policy of fire-insurance, and (2) to obtain thereon a judgment ■against the company for a loss incurred by reason, of the destruction by fire of a building and the stock of merchandise therein contained belonging to the plaintiff.
