This appeal is ruled by Gianni v. Russell, 281 Pa. 320" court="Pa." date_filed="1924-09-30" href="https://app.midpage.ai/document/gianni-v-russell-co-inc-3846632?utm_source=webapp" opinion_id="3846632">281 Pa. 320, in which the questions involved were practically identical with those now before us. The decision in that case was adverse to appellant's contention here.
