This сase is peculiar. The appellant filed her petition in the court below, claiming to be the widow of Gоttfried Grimm, and asking that $300 worth of property be appraised and set apart to her out of the estate of said decedent. The court below disallowed her claim.

In the face of this clear statement that no marriage had taken place, the mere fact that Mr. Grimm acknowledged her as his wife in the presence of witnesses, has little significаnce. Neither cohabitation nor reputation of marriage is marriage. When conjoined they are еvidence from which a presumption of marriage arises: Yardley’s Est.,
The decree is affirmed, and the appeal dismissed, at the costs of the appellant.
