PER CURIAM
AND NOW, this 7th day of November, 2023, the application to strike at 574 MAL 2022 is DENIED, and the Petition for Allowance of Appeal at 574 MAL 2022 is GRANTED, LIMITED to the issues set forth below. Allocatur is DENIED as to all remaining issues. The issues, as stated by Petitioner, are:
- Whether a surety is liable for attorneys’ fees and/or contractual interest under
the terms of a payment bond that covers only labor, materials and equipment? - Whether a surety is bound by a default judgment entered in an arbitration to which the surety was not a party and despite a provision in the bond specifying that litigation against the surety will proceed in a court of law?
