After hearing counsel for the resрondents ‍‌‌‌‌​​‌​​​‌‌​‌‌‌‌​‌‌​​​​‌‌​​‌​​‌‌​​​​‌‌‌​‌​​‌​​‌‍as well as for the appellant, this court on March 29, 1948, entered the following mandate:

By the Court. — "Judgment appealed from is reversed and cause remanded with directions to dismiss the complaint."
