Pursuant to the Alabama Supreme Court’s decision in Ex parte ‍​‌​​​‌​​‌‌‌​‌‌‌‌​‌‌‌​‌​​‌‌‌‌​‌‌​​​‌​‌​‌‌‌​​​​‌‌​‌‌​​‌​‌​​​​​‌​​‌​​‌​‌‌‌​​​‌‌​‌‌​​‌‌​​‌​‌​​​‌​​‌‌‍Drinkard, 777 So.2d 295 (Ala.2000), the trial court’s judgment is due ‍​‌​​​‌​​‌‌‌​‌‌‌‌​‌‌‌​‌​​‌‌‌‌​‌‌​​​‌​‌​‌‌‌​​​​‌‌​‌‌​​‌​‌​​​​​‌​​‌​​‌​‌‌‌​​​‌‌​‌‌​​‌‌​​‌​‌​​​‌​​‌‌‍to.be reversed and the cause remanded to the trial court ‍​‌​​​‌​​‌‌‌​‌‌‌‌​‌‌‌​‌​​‌‌‌‌​‌‌​​​‌​‌​‌‌‌​​​​‌‌​‌‌​​‌​‌​​​​​‌​​‌​​‌​‌‌‌​​​‌‌​‌‌​​‌‌​​‌​‌​​​‌​​‌‌‍for proceedings consistent with that opinion.

REVERSED AND REMANDED.
