A real-estate broker is not entitled to a commission from an owner of real estate for sale of the real estate to a customer of the broker who made an unacceptable offer for the property and with whom the broker was still negotiating, where the sale was made to such customer by virtue of the assignment in good faith of a contract for the purchase of the property from one who was not a customer of the broker.
Judgment affirmed. Stephens, P. J., and Sutton, J.,concur.
