—Order unanimously affirmed without costs. Memorandum: Although Supreme Court properly granted the motion of defendant B. Milligan Contracting, Inc. (Milligan) for summary judgment dismissing the complaint against it (appeal No. 1), the court erred in granting summary judgment to defendant Myriad Constructions, Inc. (Myriad) pursuant to CPLR 3212 (b) and dismissing the complaint against it (appeal No. 2). Plaintiff, an employee of third-party defendant General Electric Company (GE), commenced this action to recover damages for injuries that he sustained when he stepped in a hole in the raised floor of a room at a GE testing site that was being prepared for demolition by defendants.
