The rule which authorizes a new trial to be granted for newly discovered evidence is stated in section 1061 of the Penal Code in the following language: “ A new trial may be granted in all cases, when any material evidence, not merely cumulative in its character, but relating to new and material facts, shall be discovered by the applicant after the rendition of a Verdict against him,” etc. Interpreting the rule thus stated,
