Order
On order of the Court, the motions for immediate consideration are GRANTED. The application for leave to appeal the May 28, 2020 order of the Court of Appeals is considered and, pursuant to
VIVIANO, J. (concurring).
I agree with the Court‘s order remanding this case to the Court of Appeals for plenary consideration. I write separately to briefly highlight some of the issues that will need to be addressed on remand. First, it appears patently clear that two members of the Court of Appeals motion panel have no power to grant peremptory relief. See
It is incumbent on the courts to еnsure decisions are made according to the rule of law, not hysteria. Here, in addition to entering an order whose vаlidity is highly suspect, the Court of Appeals majority took the extraordinary step of directing the trial court to take immediate action despite the fact that an application for leave had already been filed in our Court.3 Typiсally, the filing of an application in our Court automatically “stays proceedings on remand unless the Court of Appeals or the Supreme Court orders otherwise.”
Courts decide legal questions that arise in the cases that come before us аccording to the rule of law. One hopes that this great principle—essential to any free society, including ours—will not itsеlf become yet another casualty of COVID-19.5
I, Larry S. Royster, Clerk of the Michigan Supreme Court, certify that the foregoing is a true and complete copy of the order entered at the direction of the Court.

Notes
ROPER: So now you‘d give the Devil benefit of law!
MORE: Yes. What would you do? Cut a great road through thе law to get after the Devil?
ROPER: I‘d cut down every law in England to do that!
MORE: Oh? And when the last law was down, and the Devil turned round on you—where would you hide, Roper, the laws all being flat? This country‘s planted thick with laws from coast to coast—man‘s laws, not God‘s—and if you cut them down—and you‘re just the man to do it—d‘you really think you could stand upright in the winds that would blow then? Yes, I‘d give the Devil benefit of law, for my own safety‘s sake. [Bolt, A Man for All Seasons (New York: Vintage Books, 1995), p 66 (stage directions omitted).]
