— Order and judgment of the Supreme Court, New York County (Tyler, J.), entered October 26, 1981, which granted plaintiff’s motion for summary judgment, denied defendant’s cross motion for summary judgment and awarded judgment for plaintiff in the sum of $10,066.41, is unanimously modified, on the law, without costs, to the extent of denying plaintiff’s motion for summary judgment and otherwise affirmed.
