MARCUS and LEMMON, JJ.,

would grant on the issue of penalties and attorney’s fees, which should not be assessed on the full amount of the judgment, but rather on the reasonable *1326amount that relator should have unconditionally tendered in satisfaction of its obligation to the insured.
