The indictments are for rape and for assault and battery with a dangerous weapon (a “spring release” knife). The case is here on an interlocutory appeal by the Commonwealth from an order of the Superior Court allowing the defendant’s pretrial motion to suppress a switchblade knife which was seized by the police during the course of a warrantless search of the van which the defendant had been driving when he was stopped and arrested.
