The defendant appeals under G. L. c. 278, §§ 33A-33G, from his convictions for assault and battery by means of a dangerous weapon, and breaking and entering in the nighttime with intent to steal.
Judgments affirmed.
The defendant’s indictment for being a disorderly person was placed on file without objection, and is thus not before us.
It is immaterial that the question was asked by the judge rather than counsel.
