Lead Opinion

Gilbert, J.

The newly discovered evidence is purely impeaching in character, and affords no legal reason for the grant of a new trial. The remaining grounds of the motion for new trial are without merit. The verdict is supported by evidence.

Judgment affirmed.

All the Justices concur, except

Dissenting Opinion

Atkinson, J.,

who dissents on the ground that the evidence is insufficient to support the verdict.

Elders & DeLoach and Hines, Hardwick & Jordan, for plaintiff in error. B. A. Denny, attorney-general, J. Saxlon Daniel, solicitor-general, and Graham Wright, contra.
