A petition filed by the City of Summerville, seeking by declaratory judgment to have adjudged null and void an ordinance under which Georgia Power Company contends that it has a right to use the streets, alleys, and public places of the city for the distribution of electricity, does not allege a controversy ripe for judicial determination, in the absence of allegations other than the mere possibility that the city could contract for the use of its streets, etc., for such purposes for an annual charge or might see fit to issue revenue certificates for the purpose of owning its own electric distribution system.
Judgment affirmed. Sutton, C. J., and Parker, J., concur.
