Action to recover damages on account of the death of Elmer Wicker, alleged to have been the result of negligence on the part of the appellant. Trial by jury, verdict for $3,500, with answers to interrogatories, and judgment upon the verdict.
Judgment is reversed, and the cause remanded, with instructions to sustain appellant’s motion for a new trial, and for further consistent proceedings.
