In a negligence action to recover damages for personal injuries, plaintiff appeals from an order of the Supreme Court, Kings County, dated April 24, 1972, which granted defendants’ cross motion to dismiss the complaint on the ground that it was barred by the Statute of Limitations and which did not pass upon plaintiff’s motion to compel the attorneys for defendants to accept service of the complaint and to amend the caption of the action.
