By denial of certiorari,, we should not ‍​​‌​‌​‌‌​‌‌​​‌​‌‌‌​‌​‌‌​‌​​​​​‌‌​​​‌​​​​‌​‌​‌‌‌​‌‌​‌‌​​‌​​​​​​‌​​‌​‌‌​‌​​‌​‌​‌​​‌‌‌​​​‌‌‌‌​‌‌‌‌‌‍be understood as holding that we agree with all the statements made in the ‍​​‌​‌​‌‌​‌‌​​‌​‌‌‌​‌​‌‌​‌​​​​​‌‌​​​‌​​​​‌​‌​‌‌‌​‌‌​‌‌​​‌​​​​​​‌​​‌​‌‌​‌​​‌​‌​‌​​‌‌‌​​​‌‌‌‌​‌‌‌‌‌‍opinion of the Court of Civil Appeals 442 So.2d 932 in this case, nor should we be ‍​​‌​‌​‌‌​‌‌​​‌​‌‌‌​‌​‌‌​‌​​​​​‌‌​​​‌​​​​‌​‌​‌‌‌​‌‌​‌‌​​‌​​​​​​‌​​‌​‌‌​‌​​‌​‌​‌​​‌‌‌​​​‌‌‌‌​‌‌‌‌‌‍understood as agreeing with the holding in C & S Construction Co. v. Martin, 420 So.2d 788 (Ala.Civ.App.1982), inasmuch as ‍​​‌​‌​‌‌​‌‌​​‌​‌‌‌​‌​‌‌​‌​​​​​‌‌​​​‌​​​​‌​‌​‌‌‌​‌‌​‌‌​​‌​​​​​​‌​​‌​‌‌​‌​​‌​‌​‌​​‌‌‌​​​‌‌‌‌​‌‌‌‌‌‍the petitioner did not request this Court to review that opinion and judgment.
