Concur: Chief Judge Desmond and Judges Fuud, Burke, Scileppi, Bergan and Keating. Judge Van Voorhis dissents and votes to reverse and to declare chapter 440 of the Laws of 1965 unconstitutional as being in violation of section 2 of article VIII of the New York State Constitution for the reasons stated in the dissenting opinion at the Appellate Division.
