We have carefully examined the very able argument of the counsel for the plaintiff in error in this case, and have been forcibly impressed- with the similarity of his views with those of the learned counsel, in the reported case of Simpson v. Mundee et col. (3 Kas., 172), and for the reasons given at length, in the opinion of the court, in .that case, the judgment of the court below, in, this case, will be affirmed.
