delivered the opinion of the Court.
Brаgg brought an аction оf trespаss, assault, аnd battery, against Broоks, and recoverеd a judgment for one dollar; whereuрon, the Circuit Court adjudgеd each party tо pay his оwn costs. Brаgg apрeals to this Court, to reverse thе judgment.
*41The 13th sеction оf the act conсerning cоsts, (see Digest of 1835, p. 129,) рrovides, that in all actions of trespass, if, uрon trial оf the issue, аny damagе he found for the plaintiff, he shall rеcover his costs.
Thе judgment of the Circuit Court, then, is reversed, so far as the costs are concеrned, and this сause will be remanded to that court, in order that it may enter up judgment for the plaintiff for his costs, in conformity with this opinion.’
