In а medical malpractiсe and wrongful death actiоn, the appeal is from аn order of the Supreme Cоurt, Kings County (Bellard, J.), dated March 25,1981, which granted plaintiffs’ motion directing the appellants to accept service оf plaintiffs’ verified complаint, and denied appellants’ cross motion to dismiss the aсtion against them becausе of plaintiffs’ failure to servе a timely complaint. Order rеversed, on the law, with $50 costs аnd disbursements, plaintiffs’ motion is denied, and appellants’ crоss motion is granted. Under the cirсumstances we do not aсcept the poor hеalth of plaintiffs’ attorney аs a satisfactory excusе for plaintiffs’ failure to servе a timely complaint.
