The facts in this ‍​‌‌‌‌‌​​‌​‌‌​‌​‌‌‌‌‌​‌‌‌‌​‌‌​​​​​​‌​‌​​‌​​‌​​​​‌​‌‌‌​‌‌​​‌‌‌​​‌‌‌‌​​​​‌​‌​​​‌‌​​‌​‌‌‌​‌​‌​‌‌‌‌​​‍record bring the case precisely within the rule laid down ‍​‌‌‌‌‌​​‌​‌‌​‌​‌‌‌‌‌​‌‌‌‌​‌‌​​​​​​‌​‌​​‌​​‌​​​​‌​‌‌‌​‌‌​​‌‌‌​​‌‌‌‌​​​​‌​‌​​​‌‌​​‌​‌‌‌​‌​‌​‌‌‌‌​​‍in Schmidt v. Slcelly, decided at the present term [ante, ‍​‌‌‌‌‌​​‌​‌‌​‌​‌‌‌‌‌​‌‌‌‌​‌‌​​​​​​‌​‌​​‌​​‌​​​​‌​‌‌‌​‌‌​​‌‌‌​​‌‌‌‌​​​​‌​‌​​​‌‌​​‌​‌‌‌​‌​‌​‌‌‌‌​​‍561], and upon the authority of that case, and ‍​‌‌‌‌‌​​‌​‌‌​‌​‌‌‌‌‌​‌‌‌‌​‌‌​​​​​​‌​‌​​‌​​‌​​​​‌​‌‌‌​‌‌​​‌‌‌​​‌‌‌‌​​​​‌​‌​​​‌‌​​‌​‌‌‌​‌​‌​‌‌‌‌​​‍of the cases there cited, the judgment will be reversed ‍​‌‌‌‌‌​​‌​‌‌​‌​‌‌‌‌‌​‌‌‌‌​‌‌​​​​​​‌​‌​​‌​​‌​​​​‌​‌‌‌​‌‌​​‌‌‌​​‌‌‌‌​​​​‌​‌​​​‌‌​​‌​‌‌‌​‌​‌​‌‌‌‌​​‍and the cause remanded.

Judgment reversed.
