This action is brought against the Greenwood Cemetery, to obtain an injunction and damages for the use, by the defendants, of a certain stone-breaking machine. The case is now before the court, upon the plaintiff’s motion for a preliminary injunction to restrain the defendants from using the machine during the pend-ency of the action. The facts are not in dispute. It is not denied that the machine in use by the defendants is an infringement
