Otherwise, order affirmed, with ten dollars costs and disbursements to the respondent. No opinion. Present — Dowling, P. J., Merrell, Finch, O’Malley and Sherman, JJ.; Dowling, P. J., and O’Malley, J., dissent and vote for affirmance. Settle order on notice.
