The Gоvernment appeals from the District Court's judgment in favor of appellee Taxpayer. ‍​‌‌‌‌‌‌‌‌​‌‌‌​‌‌‌​​‌‌‌‌‌​​‌​‌‌‌​​​‌‌​​‌​​​‌‌​​​‌‍ We affirm and adopt the opinion of the District Judge which is reported at 329 F.Supp. 1273.
