In an action for a judgment declaring that the defendant breached a construction contract between the plaintiff and the defendant, the plaintiff appeals from an order of the Supreme Court, Kings County (Bernstein, J.), dated January 16, 1987, which denied its motion for a preliminary injunction staying a default hearing by the defendant.
Ordered that the order is affirmed, with costs.

It is well settled that in order to obtain a preliminary injunction, a party must demonstrate (1) the likelihood of ultimate success on the merits, (2) irreparable injury absent the granting of the preliminary injunction, and (3) that the equities are balanced in his favor (see, McLaughlin, Piven, Vogel v Nolan & Co.,
Finally, the plaintiff has failed to demonstrate that the balance of the equities is in its favor. Lawrence, J. P., Weinstein, Kunzeman and Kooper, JJ., concur.
