The only question raised in regard to the statute oflimitations which we can determine is whether the jury was authorized to find that Litchfield did not have, for, the period of ten years from and after the time of the .giving of the deed, an office or agency in Boone county, whe^e an agent or clerk was employed, within the meaning of section 2613 of the Code. The burden of proving that such an office or agency was maintained was upon the defendant. He introduced evidence which tended to show that Browne, as agent for Litchiield, kept an office in Boone county for the purpose of
