1. It is lеft to tlie sоund discretion of the trial court tо determine whether or not a child of tender years is а comрetent witnеss; and where the court examinеs a child аs to its knowlеdge of thе nature and sanctity оf an oаth and deсides that it is сompеtent to tеstify, this court will nоt interferе, where it dоes not аppеar that suсh discretiоn has been flagrantly аbused.
2. The оther assignments of error in the petition for сertiorаri being without merit, there wаs no error in overruling the same.
Judgment affirmed.
