The question raised in this case was expressly decided in Flexner v. Dickerson, 65 ‍‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‌‍Ala. 129. The plea in abatement was properly sustained, and the judgment is affirmed.
