OPINION of the Court, by

Judge Trimble.

— This is an appeal from an order of the Fayette county court, establishing one road, and refusing to open another. From an examination of the law regulating appeals and writs of error, we are of opinion an appeal does not lie ; and that if the order and proceedings of the county court, are either unjust or erroneous, they can be corrected by writ of error only.

It is therefore considered, that the said appeal be dismissed with costs.
