In an action to declare that the Home Insurance Company (Home) is obligated to defend and indemnify plaintiff pursuant to the provisions of an insurance policy, plaintiff appeals from an order of the Supreme Court, Rockland County (Dickinson, J.), dated May 10, 1983, which denied his motion for summary judgment on the first cause of action demanding that Home defend him.
