The plaintiff commenced this mortgage foreclosure action in October 2009. The defendants failed to appear or answer the complaint. In June 2010, within one year of the defendants’ default, the plaintiff moved for an order of reference. In November 2010, before the motion was decided, the plaintiff filed a notice of withdrawal requesting that its prior motion be withdrawn. The motion was marked withdrawn in 2012. By order dated December 12, 2013, the Supreme Court, sua sponte, directed the dismissal of the complaint pursuant to
Here, in 2010, when the plaintiff took the preliminary step toward obtaining a judgment of foreclosure and sale by moving for an order of reference, it initiated proceedings for entry of the judgment of foreclosure and sale within one year of the defendants’ default and, thus, did not abandon the action (see
