This action of replevin, brought by Ayres against Mc-Conahey, was tried to a jury bn the district court and decided in favor of the defendant. The cattle in controversy Avere originally OAvned by Robert Duggan, through Avhom both parties claim title. Ayres claims ás a mortgagee and McConahey as a purchaser for full value, without notice of the mortgage. In our vícav of the case it will not be necessary to consider all the questions discussed by counsel in their briefs. One point resolved by the jury against the plaintiff is in our opinion determinative, and leads necessarily to an affirmance of the judgment. It appears from the record that the plaintiff, avIio is a banker doing business at Dakota City, had two mortgages upon cattle OAvned by Duggan. These mortgages Avere given at different times, secured different items of indebtedness and covered different cattle. Just before the note secured by the first-mortgage fell due, the cattle in dispute, some of them being-covered by one mortgage and some by the other, Avere sold by Duggan to Haakinson & Company, and by Haakinson & Company to the defendant.
