In an action, inter alia, to recover for an account stated, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Carter, J.), entered August 2, 2002, as denied that branch of its motion which was for summary judgment on its cause of action based on an account stated in the sum of $10,000.
Ordered that the order is affirmed insofar as appealed from, with costs.
The plaintiff bases its cause of action for an account stated asserting that an invoice dated August 6, 2001, was sent to, and received by, the defendant at some later point. The plaintiffs “collections manager” stated that, on October 4, 2001, about eight weeks following the date of the invoice, a representative of the defendant expressed a preference for making payments by installment, rather than in a lump sum as requested in the invoice. The present action was commenced on October 18, 2001, approximately 10 weeks after the drafting of the invoice.
On appeal, the plaintiff claims the right to summary judgment in the sum of $10,000, rather than in the sum of $29,250 as requested in the plaintiff’s complaint, and in its motion for summary judgment before the Supreme Court.
