In 1855 John W. Burney and Fannie C. Walker, in. contemplation of marriage, executed an antenuptial contract wherein the prospective husband relinquished his marital right in certain property belonging to the prospective wife, “the same to be and remain .the -sole and separate property of the said Fannie C. and for her sole and. -separate use during her lifetime, and on her death to go and vest in such child or children as may be born of said marriage.” The marriage was thereafter consummated,
