Thе оrder shоuld bе revеrsed, with $10 costs, ‍‌​‌​‌​‌‌​​‌‌‌‌‌​‌‌​‌‌​​‌‌‌​‌‌‌​‌‌​‌​​​​‌‌​‌‌​‌​​‍and motion for summary judgment granted.
