The court hereby adopts the Magistrate Judge’s Recommendation.

IT IS FURTHER ORDERED that the Complaint against Defendant Encore Receivable Management Inc., is dismissed pursuant to Federal Rules of Civil Procedure 12(b)(2), (4) and (5).
