In an action, inter alia, for specific performance of a contract for the sale of real property, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Henry, J.), dated June 26, 2001, as granted the cross motion of the defendant Theresa Buonamicia for summary judgment dismissing the complaint insofar as asserted against her, and upon searching the record, dismissed the complaint against the defendant Diego Cuervo.
Ordered that the order is reversed insofar as appealed from, on the law, the cross motion is denied, and the complaint is reinstated; and it is further,
Ordered that upon searching the record, summary judgment is granted to the plaintiff on the issue of liability as against the defendant Theresa Buonamicia; and it is further,
Ordered that one bill of costs is awarded to the plaintiff.
