Background

  • Angela Shepard was indicted on multiple sexual-offense counts and later pleaded guilty by Alford plea to an amended first-degree rape count, one third-degree unlawful sexual conduct with a minor count, and one third-degree sexual-battery count.
  • At sentencing the trial court imposed an indefinite Reagan Tokes sentence on the first-degree count: minimum 10 years, maximum 15 years.
  • The court also imposed two 54-month terms: one concurrent to the Reagan Tokes term and one consecutive, and nolled the remaining counts.
  • Shepard appealed, raising (1) constitutional challenges to the Reagan Tokes Act (jury trial, due process, separation of powers) and (2) that her sentence was excessive and failed to satisfy R.C. 2929.11/2929.12.
  • The Sixth District affirmed: it found the constitutional challenge not ripe because Shepard had not yet faced an ODRC extension hearing, and rejected the sentencing challenge under controlling precedent limiting appellate review of R.C. 2929.11/2929.12-based complaints.

Issues

Issue Shepard's Argument State's Argument Held
Constitutionality of Reagan Tokes (jury, due process, separation of powers) Reagan Tokes is unconstitutional because ODRC can extend incarceration administratively beyond the judicially imposed minimum, violating jury, due process, and separation-of-powers protections Challenge is hypothetical because Shepard has not yet faced an ODRC extension; ripeness lacking Not ripe: appeal rejected as speculative; constitutional challenges not addressed on merits
Sentence fails to achieve purposes of sentencing (R.C. 2929.11/2929.12) Sentence is excessive; trial court failed to give adequate weight to mitigation and lesser sanctions (community control, treatment) Trial court acted within discretion; appellate review of R.C. 2929.11/2929.12-only complaints is limited Not well-taken: pursuant to Ohio Supreme Court guidance, appellate courts may not reverse solely because they disagree with the trial court’s weighing of R.C. 2929.11/2929.12 factors; sentence affirmed
