- Around midnight on Sept. 4, 2014, North and an accomplice went to a field to steal marijuana but couldn’t locate it in the dark and went to an adjacent residence.
- North and his companion threw rocks and bricks at the resident Robert Tanner’s windows and shouted for him to come out; one brick shattered the kitchen window.
- Tanner, fearing for his safety, exited with a shotgun and fired toward the figures; Mahan (the accomplice) was struck.
- North was later picked up by a friend, stopped by a deputy, and subsequently confessed to Detective Reinbolt that he had gone to steal the marijuana and was shot at.
- A Seneca County grand jury indicted North for second-degree felony robbery (R.C. 2911.02). A jury convicted him; North appealed claiming (1) the trial court erred denying his Crim.R. 29 motion (insufficiency) and (2) the verdict was against the manifest weight of the evidence.
